Wren v. RGIS

Along with several other law firms, Goldstein, Borgen, Dardarian & Ho is representing “auditors” employed by RGIS Inventory Specialists in Wren v. RGIS, No. C 06-05778 JCS, which is pending in federal court in San Francisco.  We are seeking backpay for time spent by the auditors donning inventory equipment and traveling to distant work locations.  On February 6, 2009, the District Court issued a favorable ruling allowing the collective action to proceed along with class actions brought under state laws in California, Washington, Oregon, and Illinois.  (See 2009 WL 301819).  We also defeated RGIS’s summary judgment motions on nearly all the claims in the case (August 24, 2009).

Over several months in a late 2009 and into 2010, counsels for Plaintiffs and RGIS met with a mediator to resolve the case.  On July 9, 2010, the parties finalized a proposed settlement and filed it with the court.  The court granted preliminary approval of the settlement in September 2010.  Notice describing the settlement was mailed to all class members on November 15, 2010.  Class members who did not receive notice in the mail may contact the settlement administrator at 1-877-310-2748 to request a duplicate.  A final fairness hearing was  held in federal court in San Francisco on January 28, 2011.
