Mousai, et al. v. E-Loan, Inc., et al. was a putative class and collective action filed in the Northern District of California, claiming that E-Loan violated the federal Fair Labor Standards Act, the California Labor Code, relevant Wage Orders of the California Industrial Welfare Commission, and the California Unfair Competition Law by misclassifying its “loan consultants” and “exempt” employees and failing to pay them overtime wages, failing to provide them with required off-duty meal periods, failing to pay them overtime wages owed to them at the time of their separation from employment, and failing to provide accurate itemized wage statements. On May 30, 2007, the court approved a class action settlement of up to $13.6 million on behalf of approximately 500 E-Loan mortgage loan consultants employed in California at any time between December 23, 2001 and June 30, 2006.
