GBDH Wins Class Certification Against the Forty-Niners and City of Santa Clara

On July 12, 2018, the U.S. District Court for the Northern District of California (Judge Lucy H. Koh, presiding) granted plaintiffs’ motion for class certification in Nevarez, et al. v. Forty Niners Football Co., et al.  GBDH and co-counsel represent all individuals with mobility disabilities and their companions who have visited Levi’s Stadium any time since December 3, 2013 and were denied full and equal access to the Stadium’s facilities, services, accessible seating, parking, and other amenities due to defendants’ failure to construct the Stadium in compliance with disability access standards.  The court also certified a class of individuals with mobility disabilities seeking statutory damages under California law for incidents of discrimination they suffered as a result of access barriers at the Stadium since December 3, 2014.
