GBDH and solo practitioners Marni Willenson & Susan Malone recently reached an agreement with the City of Chicago in Vasich v. City of Chicago, a federal class action lawsuit challenging the City’s physical abilities test to enter the firefighter academy on the basis that it unfairly discriminated against female applicants.  The City will now use the Candidate Physical Ability Test, a less discriminatory test developed by the Int’l Ass’n of Firefighters to screen applicants.  The settlement also provides for $2 million in back pay to class members who failed the discontinued test.  The class settlement still must be approved by the federal court in Chicago.
