Vasquez v. Bank of America, N.A.

Vasquez, et al. v. Bank of America, N.A., No. 1168845, was a class action lawsuit filed on behalf of all individuals employed by Bank of America, N.A. as Liability Risk Analysts (specifically, Check Fraud Analysts and/or Deposit Fraud Analysts) in California from August 11, 2001 through October 12, 2006.  The lawsuit alleged that defendant violated the California Labor Code and the California Business and Professions Code, and engaged in other allegedly unlawful conduct by improperly designating the Liability Risk Analysts as “exempt” from California’s overtime compensation requirements.  The lawsuit further alleged violations of meal and rest period obligations, and other Labor Code requirements.  The parties reached a $2.5 million settlement which was approved on February 1, 2007.
