Rosenburg v. IBM Corp.

Rosenburg, et al. v. International Business Machines Corporationwas a collective action (FLSA) and also a class action (several states’ wage/hour laws) which we filed, along with several other law firms, in the United States District Court for the Northern District of California, claiming that IBM violated the Fair Labor Standards Act (“FLSA”), the Employee Retirement Income Security Act (“ERISA”), and various state wage laws by unlawfully classifying certain technical support workers as exempt from receiving overtime pay.  The court granted final approval to the negotiated settlement on July 11, 2007, and IBM paid $65 million to resolve the claims in the action.
